 1. Шлюб може бути укладений лише між чоловіком та жінкою. 
2. Досягення обома особами шлюбного віку. 
3. Дієздатність обох осіб. 
4. Добровільність чоловіка і жінки на укладання шлюбу. 
5. Одна особа може перебувати лише в одному шлюбі одночасно, для укладання нового шлюбу необхідно припинити будь-який ранішне укладений шлюб. 
6. У шлюбі між собою не можуть перебувати особи, які є родичами прямої лінії споріднення.
