На мой взгляд нельзя, потому что Конституция по своей сути, является характерной чертой правового государства, то есть право применяется на государственных масштабах, а ранняя отрасль права на мой взгляд это обычаи, и т. д.

Can constitutional law be considered an early branch of law? Why?

Constitutional law can be considered an early branch of law due to its historical significance and the foundational role it plays in shaping legal systems. Constitutional law refers to the body of law that establishes the framework and principles of a government, defines the powers and limitations of different branches of government, and protects the rights and freedoms of individuals within a society.

Historical Significance: Constitutional law has a long history that dates back to ancient civilizations. For example, the Code of Hammurabi, developed in ancient Mesopotamia around 1754 BCE, contained provisions that established the rights and responsibilities of individuals and the powers of the ruler. Similarly, ancient Greek city-states had written constitutions that outlined the structure of their governments and the rights of citizens.

Foundational Role: Constitutional law serves as the foundation for the legal systems of many countries. It establishes the basic principles and rules that govern the relationship between the government and the people. It defines the powers and limitations of the executive, legislative, and judicial branches of government, ensuring a system of checks and balances. Constitutional law also protects fundamental rights and freedoms, such as freedom of speech, religion, and assembly.

Evolution and Influence: Over time, constitutional law has evolved and adapted to changing societal needs and values. It has been influenced by various political, social, and philosophical movements. For example, the Enlightenment era in the 18th century brought about the idea of natural rights and the social contract, which influenced the development of modern constitutional law. The American and French Revolutions also played a significant role in shaping constitutional law by establishing principles of popular sovereignty and individual rights.
